1 - Objective

This document establishes pre-contractual information on distance contracts on the website www.keroclima.pt, referred to in article 4 of Decree-Law no. 24/2014 of February 14, and all subdomains / sub -websites. The domain www.keroclima.pt is owned by KeroClima Unipessoal, Lda.
with address at Rua do Chafariz, nº 8, 1º, Via Rara, corporate body no. 514 890 762, which is also its registration number at the Commercial Registry of Lisbon, with a share capital of 100,000.00 €, of hereinafter abbreviated as KeroClima.

KeroClima reserves the right to freely modify this pre-contractual information in order to adapt it to the applicable legislation, without the need for any prior notice.

Both browsing the website www.keroclima.pt, its subdomains and sub-websites, as well as the purchase of any product at those addresses, presupposes the acceptance of the present information and General Conditions of Use contained in this page.

 

2 - Conditions of use of www.keroclima.pt

The User undertakes to use this website in compliance with the provisions of applicable law, refraining from using the website for activities contrary to law, morality and good manners, or rights and interests of third parties.

The website www.keroclima.pt may have links to other websites, which may contain useful information / tools for its users. These general conditions will not apply to third party websites. As such, if you visit another website, redirected from our website, you should read the privacy policy of the same.

 

3 - Amendment of these Conditions

KeroClima reserves the right to unilaterally change and at any time, without prior notice, the presentation and content of the Website, its services and the general conditions of use, with the exception of the contracts already executed and in execution. These modifications will serve to improve the website while improving the services offered to the user of the website which, if it does not agree with the changes made, may resolve the contract.

All content and information contained in www.keroclima.pt and its subdomains are the property of KeroClima and therefore the use, reproduction, copying and dissemination by other means of logos, texts, images and videos contained in that website is subject to your authorization in this sense.

 

5 - Product and Price Information

5.1 Product Information

KeroClima takes into account information on the essential characteristics of products through technical descriptions shared by its suppliers and manufacturers, catalogs, photographs and videos that illustrate the products sold, in strict compliance with the best standards in the market.

KeroClima intends that the information presented is free of errors and, whenever they occur and are detected, will proceed, as soon as possible, to correct them, however, it cannot be held responsible in case of errors or omissions in the references, descriptions , characteristics, values and / or images / photographs of the products, when they arise from technical problems beyond their control and / or prevent the assessment or approval of applications of any type, support programs or financing.

 

5.2 Price Information

The retail prices shown at www.keroclima.pt and its sub-domains are presented in euros. VAT is included in all mentioned prices, unless otherwise indicated.

The costs of the shipping service are borne by the user and buyer, and are added to the total value of the selected products, when so allocated. The user will be informed of these charges before confirming his request and completing the purchase process. KeroClima reserves the right to change prices at any time. However, KeroClima undertakes to apply the rates and prices indicated at the time of making the purchase order.

In the event of a computer, manual, technical or other error, which causes a substantial change not foreseen by KeroClima in the retail price, in such a way that it becomes exorbitant or manifestly derisory, the purchase order will be considered invalid and void.

The prices and products available at www.keroclima.pt are only valid for purchase orders made through www.keroclima.pt.

We are not responsible for the content on websites external to www.keroclima.pt, namely information on coupons/discount vouchers or offers.

 

6 - Purchase process

6.1 Registration

To place a purchase order you need to access www.keroclima.pt, and register as a user on that website, filling out the electronic form following the instructions of each step. After registration you can proceed to purchase your product(s).

 

6.2 Product availability

All the articles that are in the site www.keroclima.pt with indication of the existence in stock, are available to order. The available articles in keroclima.pt have a limited stock and in periods of great demand the stocks may change and the information available in the store may not be immediately updated and therefore may be unavailable without notice. However, because we have a wide range of products available, you can find similar items that match your needs and that have the features you want.

 

6.3 Means of payment

KeroClima offers several solutions to pay for your order at www.keroclima.pt:

  • Multibanco: When selecting this method of payment you will have 48 hours, after confirmation of the order, to proceed with the payment of the same. You will find all the necessary information in an ATM, or through the internet through your bank's home banking services. In any case, just select "PAYMENT OF PURCHASES", followed by "SERVICES".
  • Bank Transfer: The customer must make a bank transfer for the data presented at the time of selecting the same means of payment.

Keroclima reserves the right to cancel the order if it is not paid within 48 hours after placing the order.


6.4 Shipping Costs

The delivery costs depend on the category of products and the type of delivery chosen. The products are delivered to the address indicated by the customer during the purchase process, through our carrier.

Delivery costs are shown at the time of order completion, unless otherwise indicated.

 

6.5 Fees and Taxes

The retail prices shown at www.keroclima.pt and its sub-domains are presented in euros. The VAT due is included in all prices unless otherwise stated.

The costs of the shipping service are at the user's expense and add to the total price of the products selected by the user. You will be informed of these charges and prices before confirming your request and completing the purchase process, unless otherwise indicated.

 

6.6 Processing and delivery of the application

The deliveries of orders placed online will be made to the shipping address indicated in the respective order, with delivery costs on request.

Important Note: Your order will only be processed after confirmation of your payment. If a false or fraudulent order is detected, it can be canceled without prior notice.

Shipping damages: All items are delivered in secure packaging. If external damage is detected in the product packaging, it must report this defect to the carrier at the time of delivery, also making reference to such damage on the document proving delivery. You should also contact our Customer Service Line (+351 939 190 190).

If you detect any disagreement or defect in the item you have purchased, you must report it to KeroClima within a maximum period of sixty (60) days from the date you have detected it by contacting our Customer Support line (+351 939 190 190 ).

We are not responsible for any delivery delays caused by our logistics partners or situations beyond our control

 

6.7 Order Tracking

7 - Warranty

The articles marketed by KeroClima at www.keroclima.pt are subject to the legal guarantee regime, in accordance with the provisions of article 5 of Decree-Law no. 67/2003, of April 8, with amendments introduced by Decree-Law no. No. 84/2008 of 21 May.

  • Returns for transport damage - If you detect any anomalies or damage caused by the transport of the article you ordered, you must notify our support line.

The warranty is valid only when the equipment is installed by an certified company/technician under the terms of no. 1 of article 7 and no. 1 of article 13 of Decree-Law no. 145/2017, of 30 November.

The warranty covers parts of installed equipment, not covering technician travel or labor required to replace parts.

The warranty for the domestic range given by the Mitsubishi Electric, Daikin and Mídea brands is three years, against duly proven manufacturing defects.
The warranty for the domestic range given by the Hitachi, Haier, Haice, LG, General, Fujitsu, Toshiba, Daitsu and Panasonic brands is two years against duly proven manufacturing defects.
The guarantee given by the brands for the commercial and industrial ranges is for two years, against duly proven manufacturing defects.

 

8 - Returns

8.1 Right of free resolution:

The consumer has a period of 14 days from the day he acquires the physical possession of the goods or the day on which he acquires the physical possession of the last good, in the case of several goods ordered in a single order and delivered separately, to proceed to the return of your order, and without having to indicate the reason, in accordance with the provisions of paragraph 1 of article 10 of DL nº 24/2014, of February 14.

It may do so provided that the article is in the same condition as it was sold, in original packaging and accompanied by all the accessories that constitute it. You can do this as follows:

Note: Never ship the article to KeroClima without prior contact with the Support Line (+351 939 190 190).

 

8.2 Return policy KeroClima.pt (online store):

If you have purchased an article in KeroClima.pt, you have a period of 14 days to return your order. It may do so provided that the article is in the same condition as it was sold, in original packaging and accompanied by all the accessories that constitute it. You can do so by contacting our Customer Service Hotline (+351 939 190 190) for shipping procedures. It is not possible to ship the article to KeroClima without prior contact with the Customer Support Line.

The return conditions are as follows:

- Articles with no sign of misuse;

- Return of the complete article, with all its components and accessories, instruction manual and original packaging in perfect condition;

Return Time: Until the 14th consecutive day, from the day of delivery.

In the case of a return, the administrative costs of € 100 (One Hundred Euros) will be charged to the client, plus the respective transportation costs.

In case of refund of Paypal payments, the respective paypal fee will be deducted.

 

9 - Repairs / After-sales service

10 - Customer Support: Help, Suggestions and Complaints

At any time, the user of the website may contact the Customer Service, by e-mail geral@keroclima.pt, or by calling +351 939 190 190 from 8:00 am to 8:00 pm every working day and from 9 am to 5 pm on Saturdays.

 

11 - Responsibility

KeroClima is not responsible for the damages resulting from any computer viruses or any other situations to which it is unrelated and that prevent the access and correct functioning of the domain www.keroclima.pt as well as the services available in it.

KeroClima declines any responsibility in the selection of the equipment by the customer in its order, informing that the client should have the appropriate advice.

Keroclima is not responsible for the content and information of discounts and/or promotions on behalf of Keroclima outside the domain www.Keroclima.pt.

 

12 - Applicable legislation

The present general conditions and all the contracts that come to be celebrated under the same are governed by the Portuguese legislation.

 

13 - Alternative Dispute Resolution

In the event of a dispute, the consumer may appeal to the Lisbon Consumer Litigation Entity
